FCC Plans to Issue New 'Net Neutrality' Rules

WSJ:  WASHINGTON—The Federal Communications Commission said Wednesday it would again issue rules to prevent Internet service providers from blocking or slowing down access to content providers that don't pay a toll to reach consumers.

However, analysts said the rules could open the door for broadband providers to cut deals with content companies like Netflix Inc. NFLX -1.97% or Google Inc. GOOG -0.71% to give their products some kind of advantage, either though speed or prominent placement.

The FCC's announcement means it doesn't plan to reclassify broadband as a public utility at present, as Democrats and public-interest groups had urged. Doing so would give the FCC much greater authority to set rules for broadband providers.

Supporters say treating all Internet traffic equally, a concept known as net neutrality, is crucial to keeping the Internet open and allowing smaller companies to compete with the biggest content providers. But the courts have ruled against the FCC's previous attempts to enforce net neutrality on companies like Comcast Corp. CMCSA -3.66% and Verizon Communications Inc. VZ +1.20% that provide Internet connections to households and businesses.

Last month, the U.S. Court of Appeals for the District of Columbia Circuit threw out FCC rules barring providers from blocking or slowing down websites, but it acknowledged the FCC has some authority to regulate broadband-company practices under a section of the 1996 Telecommunications Act that gives it broad authority to encourage U.S. broadband service.

The FCC said Wednesday it won't appeal the D.C. Circuit's ruling. Instead, it plans to take advantage of Section 706, of the law to propose new rules in the late spring or early summer, after soliciting public comment.

"The FCC must stand strongly behind its responsibility to oversee the public interest standard and ensure that the Internet remains open and fair," FCC Chairman Tom Wheeler said in a statement. "The Internet is and must remain the greatest engine of free expression, innovation, economic growth and opportunity the world has ever known."

The court said in January that the FCC could impose a "no blocking" rule if it found a different legal justification. Mr. Wheeler's statement indicates the FCC will do just that, by establishing a minimum standard for how broadband companies treat content. The rules would likely outline expectations and unacceptable practices for broadband providers, and provide for case-by-case enforcement when websites complain of unfair discrimination.

Analysts said the new rules could pave the way for deals between Internet providers and content companies to carry their content to consumers at higher speeds. Paul Gallant, a telecom policy analyst at Guggenheim Securities, said his reading of the commission's principles is that the agency is more likely to focus on policing anti-competitive conduct than on discouraging the content deals.

"I think the FCC will be inclined to permit voluntary paid prioritization deals," he said.

Even with that caveat, Republicans are opposed to the new proposed rules. "I am deeply concerned by the announcement that the FCC will begin considering new ways to regulate the Internet," FCC Commissioner Michael O'Rielly said. "The Obama administration refuses to abandon its furious pursuit of these harmful policies to put government in charge of the Web," House Energy and Commerce Chairman Fred Upton (R., Mich.) and Rep. Greg Walden (R., Ore.) said in a statement.

Any rules would have to be approved by a vote of the five-member commission, which includes three Democrats and two Republicans.

Net neutrality supporters, however, were disappointed with the FCC's decision not to reclassify broadband Internet as a public utility, which they had argued was the only way to make the rules stand up in court.

Andy Schwartzman, a telecom lawyer and adviser to the anti-media consolidation group Free Press, said not reclassifying broadband "would be repeating the biggest mistake" made during prior efforts by former FCC Chairman Julius Genachowski.

Broadband providers have argued that reclassification would be disastrous for the industry because it would subject them to regulations designed for the landline phone system. "We think reclassification would probably be the ultimate death of the broadband market," Comcast Executive Vice President David Cohen said in an interview last week. "We think it would dry up private investment and destroy all the gains made in the broadband market in the U.S."

Cohen's comments were made in the context of his company's bid to acquire Time Warner Cable Inc. TWC -2.75% Comcast has already agreed to abide by the FCC's net neutrality rules, even though they were struck down in court, as part of its acquisition of NBC-Universal in 2011. Comcast has also agreed to extend the agreement to Time Warner Cable Inc. subscribers if that acquisition is approved.

Mr. Wheeler has left the reclassification option open for now, which could serve as a deterrent for broadband providers seeking to challenge the rules in court again.

A Verizon spokesman said the company said it wouldn't appeal last month's court ruling, and that it is too early to determine whether it would challenge the FCC's latest rules.

As part of the process, the FCC will also examine ways to encourage competition in the broadband market. That could include removing legal restrictions that prevent cities and towns from building their own broadband or Wi-Fi networks.

I can make the case that I don’t think they would.  Most people think instinctively, reflexively, the media not gonna put up with it something like that.  “No way! You’re gonna have a government monitor in my newsroom? You’re gonna be quote/unquote ‘monitoring’ the stories I choose to cover and the stories I don’t want to cover, and you are gonna be cataloging what you think is my bias?  No way, pal!”  But I can see where, given the current circumstances that exist today, they wouldn’t oppose it. 

In fact, I could make the case to you that they would welcome it.  I explained this to Snerdley today.  He could not believe me.  He did not believe that I was being serious.  “You’re joking,” he said.  No.  I can make the case where journalism schools would not oppose it but instead will support it — and I’ll bet I could make the case to you, given current circumstances.  I think the media might look at it as an opportunity to get even closer to Obama.  I think some might look at it as a way of impressing Obama. Michelle Obama’s Nutritional Finger-Waggling

Amen!! I felt exactly the same way… How dare Michelle Obama intimidate and scold a disciplined Olympian who just won two Golds for her country for splurging by eating an egg McMuffin. (NBC for once had the fortitude to title their coverage… Michelle Obama scolds Gabby Douglas instead of ‘teases’ like a lot to the a_s kissers did, but then felt they had to soften it by adding a lot of kitsch to their video coverage).

Wow talk about being out of touch and a wet blanket. It almost made me feel bad for the President and certainly did for their girls!

I mean really? For an Egg McMuffin? These Olympic athletes can eat endless calories because they work out all the time and if you know this gal’s story… she is disciplined and deserves a splurge! And it wasn’t like she said ‘I ate a quarter pounder with cheese, fries, and a chocolate shake followed by an apple pie…’ It as an egg McMuffin~

I am not a McDonalds defender. Americans need to eat better and we certainly eat too much fast food but this is not the way to cure that ill!

God help us if Ms. O and crew get 4 more years to police our food and everything else! M~

Setting Her Back?

On Monday night’s renewal of the Jay Leno show, Michelle Obama appeared along with Olympic gymnast Gabby Douglas, and as the discussion went on, Douglas mentioned eating a celebratory Egg McMuffin from McDonalds. Self-appointed National Nutrition Czar Michelle Obama, who enjoys telling everybody on the planet what to eat, chided Douglas over the choice. I realize this was said mainly in jest, but frankly, Michelle Obama needs to shut the hell up. Gabby Douglas needs Michelle Obama as a nutrition adviser like I need her husband as an automobile consultant. “No, I don’t want an exploding electric car, Mr. President.” There’s something wrong with the Obamas, and it comes down to their desire to run the lives of others, but more than this, there is something unseemly about a woman who has no accomplishments of note (beyond marrying a guy who was elected President), counseling or even jokingly chiding an Olympian about her choices of foods.

Really, what the hell has Michelle Obama ever accomplished? She was an attorney for a while, and there are questions to whether she can still practice. And she served in some positions in Chicago that appeared to have been little more than political favors to her husband, where a cloud still hangs over her (and cronies Axelrod and Jarrett’s) decisions and programs. Apart from that, and apart from spending millions of taxpayer dollars on her seemingly endless string of vacations, I can’t imagine what has qualified the lady to give any sort of nutritional advice to anyone, never mind an Olympian who has managed to train her whole life long and win Olympic glory all without the help of Michelle Obama. There were no quotas, no set-asides, and no special favors for Gabby Douglas, her only way forward and up to the top available having been to achieve it by her own efforts. She didn’t obtain Olympic fame and fortune by marrying a gymnastics judge.

I have no problem with first spouses who are accomplished in their own right. I think it’s terrific to see First Ladies becoming involved in various causes, but they shouldn’t have any official power, and in truth, they shouldn’t have any role in governance because we don’t elect them. Until Hillary Clinton, most first ladies tended to restrain themselves to charitable activities and voluntary efforts, more or less, but something was wrong with Hillary Clinton becoming involved in health-care plans, just as there’s something wrong with Michelle Obama nattering-on about nutrition. Hillary Clinton is not a medical professional, an insurance professional, and at the time, she hadn’t been elected to anything. Similarly, Michelle Obama is not a nutritionist, knows damnably little about food beyond consuming it, but certainly little about its production, and yet here she chastises the Olympian? Of course, she also toured Army posts earlier this year examining their dining facilities, and what nutrition is available to our soldiers, as if the Army needs her advice or direction.

I’m tired of this nonsense. I’m tired of her fake wisdom and her husband’s fake Presidency. For the better part of four years, we have had to listen to these two self-aggrandized nit-wits chiding the nation over this or that, but frankly, it’s time for them to shut the hell up. At every turn, here they are to remind us of a ruling family in some tin-pot dictatorship, like Ferdinand and Imelda Marcos of the Philippines, and while we can guess than Michelle doesn’t have 2700 pair of shoes, she does seem to have a thing for belts. I don’t believe the American people hired Barack Obama to provide a nutrition consultant in the form of his wife, and I don’t think the American people need any more lectures on the evils of oil. It’s long past time for these two to leave the White House, and be stricken from the American memory in the same way we have tried to forget James and Rosalyn Carter.

The next time I see Michelle Obama doing anything athletically, gracefully, and with extraordinary discipline, it will be the first, but until then, she should leave the nutritional concerns of our Olympians, our soldiers, and indeed our entire nation to qualified parties. When I notice how emaciated Barack appears, I wonder how well she’s looking after her own family’s nutrition. In stark contrast, like the champion she is, Gabby Douglas handled the situation with good humor, and her gracious approach sits well with her Olympic achievement. It’s too bad we don’t have a First Lady with similar grace and class.

Let us also remember that McDonald’s is a huge multi-national (CFR elitist company) sponsor of and contributor to the Olympics… But can you really take their money and demonize them at the same time?

Parents Furious After School Teaches Graphic Sex Class

Pannkuk and her husband sat their daughter down and asked her explain what she was taught in the class.

“You take a man’s penis and you put it in your mouth – that’s what the girls do to the boys,” their daughter told the couple. “The boys spread the girls legs apart and put their mouths down on the vaginas.”

Pannkuk said he became enraged as his 11-year-old daughter recounted what the principal had told the classroom.

“Steam was coming out my ears,” he said. “I was very, very upset. I understand that they need to teach these kids (basic) sex education – but 11-year-olds? I have a problem with that. The wife and I were very – very upset.”

Gilliland said another child explained to their parents that it “was basically like a lollipop.”

Gilliland said he has no problem teaching sex education – but this particular class went too far.

“It’s one thing to teach about reproduction,” he said. ‘She knows about breeding her guinea pigs, horses, dogs and so on. She knows how babies are born and how they are created, but when they go teaching them these extra acts – it’s appalling.”

Mrs. Gilliland said it’s important for parents across the nation to get involved and to pay attention.

“Be more involved in your school,” she said. “See what your kids are learning. Pay attention. Talk to your kids.”

She said many of the families are now dealing with the aftermath of the class.

“She should be bouncing on the trampoline, riding horses – doing normal kid stuff,” she said of her daughter. “We don’t need to talk about that stuff at that age.

But now they do.

“The damage is done,” Pannkuk said.

Democrats Beginning to Admit that Obama Could Lose… Was Last Week Obama’s Kick-Off to an Inglorious Demise?

As I was working away at my desk with ‘The Five’ playing in the background, died in the wool liberal Democrat Bob Beckel, the youngest deputy assistant secretary of state ever, for the Carter administration and the campaign manager for Walter Mondale's 1984 presidential campaign just freely admitted that Obama is losing in the polls right now between 5 and 7 points.

The Democrat desperation is showing from all sides.  The decisive loss in Wisconsin was  perhaps the beginning of the true panic. Then there have been the consistent torpedoes being thrown at Obama by former President Clinton; the devastating jobs numbers combined with ever closer looks at the ‘real’ job loses and manipulation of the figures that have been fed to the public by the Obama administration; the recent vetting of Obama that should have but didn’t happen in 2008 and the ‘failure’ of almost every attempted ‘created diversion’ by the Obama campaign... including their latest media blitz. 

Diane Macedo from the Fox Business network appeared on Huckabee over the weekend, along with Charlie Gasparino.  She said that the White House continues to repeat the 4.3 million jobs created number as fact, but to get to that number they only count jobs lost and created since 2010.  They have completely taken the millions of jobs lost in 2009 under President Obama out of the equation. In reality they have only created 55,000 net jobs.

We are also now losing thousands of baby-boomers monthly from the job market as they are retiring in droves.  These jobs and people are also not being portrayed accurately in the job number calculations just like other people who have stopped looking for work, no longer qualify for unemployment or have taken low-paying or part-time jobs so are underemployed.

In actuality, unemployment, if calculated correctly using all the figures, is somewhere at an average of between 14% and 16% across the country (Donald Trump said in an interview with Greta Van Susteran that it was more like 21 to 22%) and whichever set of numbers you choose they do not include the underemployed.

Then add to this Obama’s latest so-called ‘gaffe’ where he said that the private job market is doing just fine but the government sector needs help. Reince Priebus, RNC Chairman, said this was not a gaffe but a look into Obama’s ideology and the beginning of a push for another bailout. Additionally there is the new focus on classified security information having been allegedly ‘purposely’ leaked from the White House to make Obama look good and to up his numbers (They have upward of 13 sources who have come forward.)  Plus there is a renewed cry for information, truth (and for heads to roll) on the Fast and Furious front.  Many now believe that both Eric Holder and President Obama knew/know about both. McCain says Eric Holder has no credibility to oversee the leaks investigation. Most who have followed Fast and Furious and understand the connections within the White House circle (the Chicago Team) would agree.

For a brilliant guy President Obama sure says a lot of stupid things. Obama’s latest gaffe was so bad that even Candy Crowley was hammering David Axelrod on it. Obama claimed that the private sector was doing just fine and basically he already fixed that - it was just state & local governments that are struggling. As reported early last Wednesday morning on Breitbart, the media had obviously conspired with the Obama campaign over the Memorial Day holiday to start last week off with a well-organized media blitz meant to knock Romney off message and to aid and abet the Obama campaign's desire to define the former Massachusetts governor as an extremist. And we all saw this play out as the corrupted MSM blew up a wildly hypocritical narrative around Romney's ties to Donald Trump.

Well, I have good news… According to Byron York, Romney's refused to take the bait.

Mitt Romney's refusal to repudiate Donald Trump sent a signal, both to Democrats and the voting public: With the nation's future at stake in this November's election, Romney will not accommodate calls that he disown supporters who make ill-considered, unpopular, or sometimes outrageous statements on matters not fundamental to the campaign.

Romney aides believe that cooperating with Democrats and media figures who are demanding a Trump disavowal would most certainly lead to more calls for more disavowals of other figures in the future -- leaving Romney spending as much time apologizing for his supporters as campaigning for president. Team Romney views it as a silly and one-sided game designed to distract voters from the central issue of the race, which they remain convinced will be President Obama's handling of the economy.

By one-sided, they mean not only that Obama has not disavowed SuperPAC contributor Bill Maher for a number of Maher's statements that were particularly insulting to Republican women. They also mean the press, with, as Team Romney see it, questionable associations of its own. Has David Gregory, moderator of NBC's "Meet the Press," repudiated his colleague Al Sharpton, the MSNBC host with a decades-long record of incendiary statements and actions? ...

Another reason Romney is wary of such concessions is that John McCain tried them, and they didn't do him any good.

Romney also raised more money last month than any other politician has ever done.  He raised more money last month than President Obama. Mitt Romney and the Republican National Committee reported they raised a combined $76.8 million in May, about $17 million more than President Obama and Democrats collected (who were previously considered an unbeatable fundraising machine).

On Wednesday, President Obama took another break from Washington by flying to California for a series of five fundraisers, including a gay-rights gala in Beverly Hills. (Remember that one… where Obama lowered himself and the dignity of his office to tell an off-colored sex joke about his wife?) But on Thursday, fundraising statistics released by both campaigns showed that GOP nominee Mitt Romney had surpassed President Obama for the first time in May, out-raising the president’s campaign $76 million to $60 million.

“We got beat,” said Obama campaign manager Jim Messina

Obama has nearly taken employment back to the 1950s… and that is not a good thing; only 58.6 percent of all Americans are employed — 1 percentage point higher than in 1956… under 59 percent of Americans employed for 33 consecutive months and counting.  The most startling figures that Team Obama consistently take out of the equation are exactly that, how few people are actually working compared to the population and the pool of available workers, for they don’t count all those that have dropped off the unemployment rolls and those that are underemployed.  Amazingly the highest unemployment is among blacks, Latinos, teens and recent grads (who are back living with their parents, have no work or are underemployed and have student loan payments) yet they seem to be the last to see that the Obama hope and change promise was all an illusion.

Stuart Stevens, who is Mitt Romney’s chief strategist, is also a novelist and memoirist, and last week he offered up a couple of bon mots (witticism or good words) that help frame the challenge President Barack Obama faces as the economy sputters.

President Obama capped off his inglorious week by holding a hastily called news conference at the White House on Friday in an attempt to shift focus from the Wisconsin loss as some in the Democratic Party blamed Pres. Obama for staying out of the Wisconsin fight and essentially abandoning them... plus no doubt wanting to spin the bad job numbers.

It turned out poorly for him.

During his discussion of the economy, President remarked that the “private sector’s doing fine.” Within an hour, Governor Romney and other GOP leaders were ridiculing the president for his comment and preparing campaign videos to exploit the gaffe.

As the President walked out of that press conference Friday, a reporter called out to him for his reaction to the Wisconsin recall election. The president just kept walking.  But before he reached the door, another reporter shouted a final question, asking Mr. Obama if he’d enjoyed the pie that his self-appointed ‘Health Czar wife’ had purchased for him… reminding the room that giving up pie, large sodas and fast food is for the little people who need to be led.  At least Marie Antoinette was willing to let them eat cake!

Obama Assembling De Facto Propaganda Ministry

The U.S. State Department is planning to “buy” media broadcasts, as the Obama administration assembles a de facto propaganda machine, according to documents that reveal the president’s plans moving closer to the 2012 election.

According to information WND located via routine database research, State’s Bureau of Public Affairs is soliciting the help of “global news coverage service providers” to create and disseminate department “news.”

The selected contractor will provide “full-time, 24/7 service,” the Statement of Work for the plan said.

“The department seeks a service provider for full, turn-key news-style global television coverage of ad hoc open press events featuring the Secretary of State and other officials across the United States and throughout the world,” according to the SOW, “and to send this content back to the department’s Washington headquarters…”

Upon receiving these privately packaged productions, the department, in turn, “will distribute this video content to media organizations through an array of traditional and new media platforms.”

Indeed, just as the department is awaiting contractor bids on the project, Secretary of State Hillary Clinton’s representative at the World Press Freedom Day in Tunisia heaped accolades upon UNESCO for hosting the annual event.

In a “tweet” from Tunisia, Assistant Secretary of State for International Organization Affairs Esther Brimmer said, “I applaud the tireless, continuing work of #UNESCO in promoting the ideals of free and open media.”

Brimmer delivered remarks on behalf of the Obama administration during the opening ceremony, along with presenting a video speech from Clinton.

Referring to the Arab Spring demonstrations across the Middle East and North Africa, Clinton said, according to a prepared statement, “Voice by voice, text by text, Tunisians, Egyptians, Libyans and many others have dared to say what they believe and stand up for their own rights.

“Many others have dared to report on what they see happening, even when their lives were at risk.”

The State Department plan is twofold: to hire a single contractor to provide television news crew services on the one hand, and to provide transmission/streaming services as a corollary service.

“The television news crew category is both one and two-person crews, and includes one and multi-camera productions,” the SOW pointed out. “The transmission category includes both traditional fiber, terrestrial and satellite-based as well as file-based and Internet delivery platforms.”

The use of such government- as well as industry-funded broadcasts, known as “video news releases,” or VNRs, has increasingly come under fire in the past decade.

VNRs “are segments designed to be indistinguishable from independently produced news reports that are distributed and promoted to television newsrooms,” according to Source Watch, a Center for Media and Democracy project that chronicles the intersecting of public relations and public policy.

The General Accountability Office – the investigative arm of the U.S. Congress – in 2005 declared that several federal entities, such as the Department of Education and the Department of Health and Human Services, may have violated the law by disseminating VNRs as fact-based news reports.

Subsequent to the GAO’s findings, the “Stop Government Propaganda Act” was introduced to rein in and punish such activities; it died, however, after being introduced in the Senate Judiciary Committee.

Proponents of VNR distribution claim that use of the video products is wholly legitimate. The Public Relations Society of America is that a VNR simply is “the video equivalent of a press release.”

The organization does advocate that industry members abide by certain parameters to ensure the integrity of VNR usage:

1. Organizations that produce VNRs should clearly identify the VNR as such and fully disclose who produced and paid for it at the time the VNR is provided to TV stations.
2. PRSA recommends that organizations that prepare VNRs should not use the word “reporting” if the narrator is not a reporter.
3. Use of VNRs or footage provided by sources other than the station or network should be identified as to source by the media outlet when it is aired.

Despite congressional refusal to crack down on VNRs, the Federal Communications Commission issued a reminder to licensees of their sponsor-identification requirements under the Communications Act or 1934. Rather than holding liable the creators of the reports, the commission has placed the burden of disclosure on who ultimately airs the VNR.

“These rules are grounded in the principle that listeners and viewers are entitled to know who seeks to persuade them with the programming offered over broadcast stations and cable systems,” the FCC said.

When such VNRs are aired, “licensees and operators generally must clearly disclose to members of their audiences the nature, source and sponsorship of the material that they are viewing.”

Although the FCC continues to enforce these rules, the penalties arguably have been light.

Last year, for instance, it issued a forfeiture order to Fox Television Stations, Inc. when station affiliate KMSP-TV of Minneapolis used – but failed to identify – a General Motors-provided VNR during a news broadcast.

The FCC fined Fox $4,000 for failing to disclose GM sponsorship of the report.

Among other VNR-related enforcement actions, in 2007 it imposed a $4,000 fine on Comcast Corp. for also violating the sponsorship disclosure rules. Comcast’s CN8 news affiliate in that case had aired a VNR produced on behalf of Nelson’s Rescue Sleep.

The FCC soon after separately slapped a $16,000 forfeiture against Comcast for airing two VNRs from General Mills and Allstate, respectively.

The State Department through May 21 is reviewing contractor proposals in response to the new solicitation. It did not disclose the estimated cost of the endeavor, for which it will award a year contract with four one-year options.

Opponents Mobilize to Overturn California’s New Law Mandating Gay History in Public Schools

SACRAMENTO, Calif. (The Blaze/AP) — California’s secretary of state on Tuesday cleared a group to begin collecting signatures for a ballot referendum to overturn a first-in-the-nation law requiring public schools to teach the contributions of gays and lesbians in social studies lessons.

The bill, SB48, was signed into law by Gov. Jerry Brown earlier this month, making California the first state to mandate such lessons in public school curriculum. The requirement is set to take effect in the 2013-14 school year.

It took opponents less than two weeks to draft the referendum challenging the move. At a time of budget cuts, California schools should be focused on improving student performance and lowering the high school dropout rate, said Paulo Sibaja, a spokesman for the group Stop SB48.

“Politicians have no business writing textbooks. It should be left to the historians and academic experts,” she said.

Backers of the referendum will need to gather 504,760 signatures from registered voters by Oct. 12 to qualify for the next statewide ballot. Sibaja said paid and volunteer signature-gatherers will be used to try to meet the requirement.

Supporters of SB48 said it will teach students to be more accepting and perhaps help end bullying of gay students. It also ensures that students are taught about the contributions of people who are gay, lesbian, bisexual and transgender.

“It’s important for us right now to educate Californians about what the bill does and does not do,” said Rebekah Orr, a spokeswoman for Equality California, a leading lesbian, gay, bisexual and transgender rights advocacy group in California. “We want to be clear that this bill is about teaching historical figures and not just LGBT people.”

The Constitution Worked

Yesterday, a little after two in the afternoon, eastern time, millions of people tuned in to see what they expected.  They got a surprise. Instead of seeing a woman convicted of murdering her child, they saw the Constitution working.

Why isn’t this shocking?

It is shocking that someone is found not guilty of murder.  Acquittals on First Degree Murder charges are pretty rare.   It is even more rare when the state is seeking the death penalty.

Many were outraged that the jury acquitted Casey Anthony.  There is nothing to be outraged about.  It was a great example of the Constitution at work.

Thanks to the 6^th Amendment of the Constitution, Casey Anthony had the right to a fast, speedy and public trial by a jury of her peers.  It did take the case three years to get to trial, but that was as much the fault of the defense as the State.

Casey Anthony was given the right to confront her accusers.  She was present in court at every occasion and during every minute of her trial.  She was given the right to subpoena witnesses.

Thanks to the 5^th Amendment, Casey Anthony was indicted by a grand jury.    She had the right not to testify and exercised that right. The prosecutor in the case was not allowed to comment on the fact she did not testify

Thanks to the 5^th Amendment, she will not be tried for this case again.  The government may not retry a case over and over again until it gets the verdict it wanted.

The Casey Anthony trial was problematic to begin with.  The State had some huge problems to overcome.  In order to secure a murder conviction, the State must not only prove that someone was murdered, but they were murdered by the accused.   This was the huge problem this case had.  No one saw the death of the child.  By the time the child’s body was discovered, it was almost impossible to determine the cause of death.

Casey Anthony never confessed to killing her child.  She did lie to the police and that is suspicious in itself, but without a witness to the murder or a confession, securing a conviction is all but impossible.

Trying a murder case is tough.  I know.  I have tried them.  I spent 23 years practicing law, including ten years as a prosecutor.  I just tried what is likely my last jury trial two weeks ago.

Most of the time, the jury gets it right.

Trial by jury may be an imperfect system, but it is better than all of the alternatives.  The trial by jury was specifically added to our constitution in criminal cases as a check against the overwhelming power of the state.

Bad facts make bad cases and the Anthony case had a lot of bad facts.  Casey Anthony may well have killed her child and may well have gotten away with murder.  But the Constitution that protected her and allowed this verdict protects each and every one of us against political prosecutions.  

What we saw with the verdict yesterday was the Constitution working, just like it is supposed to.

As horrifying as this case was, I can live with that verdict.

#1  Thanks for this post!!  Couldn't have said it better.  I believe down deep that Casey Anthony did it but you are right the Constitution worked.  And we must always support the Constitution, even if we don't like the outcome, just like we must insist that the Constitution is upheld, when we like it or not.  And this is what isn't and hasn't happened with Obama, his policies, his bending of the law and as many agree even his eligibility. As horrific as this case and the death of this little girl was, we all need to wonder why America in general isn't as interested or involved in the death of our nation!

I do feel that the jury was absolutely wrong, with the evidence produced, in not charging Casey with neglect!

As for Casey, if the jury got it wrong, we all know her final judgment will come from a much higher "juror" and just look at OJ, sometimes is doesn't take until the next life!

As for the comment below about Casey being appointed the "The Safe Toddler Czar", if we don't all start speaking and standing up and demanding things change... it could happen! #2 My first thought was... this is the jury I would want if I were accused.

I really expected a guilty verdict, but I couldn't say she did murder the little girl or how.

I couldn't figure who else would have. She had responsibility for her. Didn't report her missing.

Didn't act like she was sorry to not know where she was. Acted very guilty, by her lack of worry.

But proof, really , I think the jury was right. That doesn't mean she's innocent, or that I believe she's innocent.

Just that they didn't prove her guilty.

 

#3 This woman got away with murder.  Like O. J., she should not be allowed to profit from her infamous crime.  In my opinion, the jury got it wrong, just like in the O. J. case.  I will boycott any company, publisher  or advertiser that promotes this woman.  This is outrageous.

The constitution worked. However, justice was not carried out for little Caylee. If Casey Anthony did not murder her child and throw the body away in the swampy area, then who did?  She was the last one to have been seen with the child.  She lied and covered up the child being missing for 31 days, long enough for decomposition to have set in so that cause of death could not be determined.  By the time the body was found almost six months later in the swamp, there was no DNA or forensics. 

The verdict had to be reached using common sense.  The technicalities surrounding forensics, meant little because of the badly decomposed body.  Casey made sure that what did not happen through natural decomposition, the animals would take care of the rest. 

In a just turn of fate, perhaps Casey's remains will be decomposed, thrown into the swamp,  and gnawed away by the animals, like her daughter's.  That would be justice and fate.   What goes around comes around.  Until that day comes, she is a "persona non gratis" in our society.  Like O. J., wherever she goes, her infamous deed will follow her.   She must not be allowed to profit from this crime, which will go unpunished by the criminal justice system, and our constitution.

I touched the stones of Jerusalem, thinking that King David, King Solomon and so many others had walked those paths, and I admired the beauty, the miracle that the Israelis had managed to build, right there in the middle of the desert.

And I admired the Israeli Jews, my tough brothers and sisters, and I kept smiling, thinking, "it’s okay, be patient, they are fighting for survival in the middle of those barbarians."

Last week, during a speech in Congress, most of us felt the force of leadership of a man whose country’s safety and existence were at stake. We heard his voice resonate through Congress like a roar, strong and decisive.

He was one of King David’s successors, Benyamin Netanyahu. The Lion of Judah had been awakened. 

A few days earlier, President Obama had unexpectedly asked flat out that Israel go back to its pre-1967 borders, a veiled maneuver to achieve the destruction of America’s best ally. He asked them to surrender territory that is strategically crucial to their defense from the usual, yet ever more ferocious enemies of the State of Israel.

But what, really, are Obama’s objectives? Let’s look his track record:

URANIUM

On December 2, 2010, the Obama administration approved passing control of two uranium mines in Wyoming to a Russian company, Uranium One, after the Nuclear Regulatory Commission approved transferring the mines’ licenses.

Thus Russia gained control of half of US Uranium production at the same time that it has been supplying uranium to Iran’s nuclear program.

On January 1, 2011, Ukraine sent a shipment of highly enriched Uranium to Russia for secure disposal, a move Obama lauded, saying it "advances a top priority for my administration and for global security."

The shipment adds, with Obama's approval, more weapons grade material to the Russian stockpile, again at the same time that Russia supplies uranium to Iran's nuclear program.

ARMS SALES

In February, 2010, Obama banned weapons sales to Israel, and at the same time authorized $10 billions in arms to Arab-Muslim states belonging to  Arab League, including Egypt, Kuwait, Jordan, Morocco, Saudi Arabia and the United Arab Emirates.

In September that year, Obama authorized the largest arms sale ever to Saudi Arabia, worth $67 billion. The package included 84 new F-15 fighters, as well as upgrades to 70 fighters already in the Saudi arsenal. It included three types of helicopters: 70 Apaches, 72 Black Hawks and 36 Little Birds.  The sale also included $30 billion in ships and hardware to upgrade the kingdom’s naval forces.

GROUND ZERO MOSQUE, AKA PARK 51

Frank Gaffney of the Center for Security Policy reported,  “At a White House celebration of Ramadan tonight in the company of representatives of several of the Nation’s most prominent Muslim Brotherhood front organizations, President Obama announced his strong support for one of their most immediate objectives: the construction of a mega-mosque and “cultural center” at Ground Zero [area].  In so doing, he publicly embraced the greatest tar-baby of his presidency.”

Naturally, the President has been accused by relatives of 9/11 victims of “abandoning America” over support for Islamic cultural centre.

ITAMAR, ISRAEL

You might wonder, why bring up Itamar at this point?

We all remember the horrible massacre on Shabbat, when beasts murdered five members of the Fogel family while they were sleeping.

The Muslim Palestinian terrorists slit the throats even of the children, among them tiny three-month old Hadassah.

Slitting throats, Muslim-terrorist-style, is done slightly, so as to make the victim die slowly, in the most horrible pain while the blood runs out their bodies.

Why did this happen?

My friend, Leah Goldsmith, the wife of Itamar’s mayor, stated at a rally of support we hosted in NYC: “We are at war when people come on Shabbat to slaughter men, women, and children. President Obama has asked the Israeli government to remove the soldiers from the Tapuach junction near us, which protected the Jerusalem-Shechem road. [The Israeli government accepted Obama’s demands.] So you got the butchering of a family, then a bombing at a bus stop because the White House thinks that soldiers checking Arabs is a human rights violation.

"Itamar is on a mountain. To the west we can see the skyscrapers of Tel Aviv, and to the east, we see the Jordan Valley. Do you want us, or Hamas, on that mountain?” (Arutz Sheva, March 27, 2011)

G8 FINANCIAL SUPPORT FOR SO-CALLED “ARAB SPRING”

In the same vein, Obama last week attended, in Deauville, France, the G8 summit of the leaders of some of the world's most powerful economies. They retain this status even though America is quasi-bankrupt and the other members, except Germany, are in dire straits as well.

At the G8 summit in Deauville, France rich countries and international lenders are aiming to provide $40 billion in funding for Arab nations trying to establish free democracies. The overall message from President Barack Obama and the other G-8 leaders appeared to be warning autocratic regimes in the Arab world that they will be shut out of rich-country aid and investment, while new democracies are encouraged to open their economies. During the summit, despite America's near bankruptcy and despite the fact that Joplin, Missouri had been ravaged and hundreds of Americans killed by devastating tornadoes, the President of the United States decided that his top priority should be the financial support of Muslim countries by the G8. He claimed this would advance the cause of democracy in what his administration has taken to calling the "Arab Spring."

Obama succeeded in getting $40 billion committed to advance the “Arab Spring,” rather than trying to get it from the wealthiest Muslim countries, which should and could create that fund to help their own.

Notwithstanding America’s bankruptcy, Obama could have been presidential enough to get some of that money for the people of Texas and Missouri, ravaged by fires and tornadoes, respectively. He might even have suggested that the money go to Japan, a nation devastated by earthquake, tsunami, and nuclear disaster.

Obama's priorities are not surprising from a man who, in his “Middle East” speech on May 19 said that, “we are connected to that region by forces of faith.”  Muslim faith, that is.

Each item in this list might seem small, but taken together, the picture they paint of Obama's priorities is damning. And the full list is much, much longer.

When Obama demands bluntly that Israel go back to its pre-1967 borders, it is a veiled way for him to set up Israel’s destruction.

Sadly, the suicidal collective viewpoint that has been developing in Israel since its inception is moving the likes of Ehud Olmert to speak up, in spite of the fact that Olmert’s moral corruption strips him of any kind of moral authority to speak up on any grounds.

Israel should only be burdened with one enemy, the enemy without.

Israel is at war, and this critical fact is ignored when it allows the enemy within, emboldened by Israel's most important ally, to become vocal and express opinions that are detrimental to the country’s security. 

Whoever speaks of giving up the strategic zones that are historically and forever connected to the heartland of the Jewish people should be incarcerated. These verbal attacks are even worse than exploding a grenade in the middle of innocent civilians.

The effect of a grenade stops with the victims.

The impact of any verbal and ideological attack by Israelis who are unaware and unwilling to identify themselves as Jews is such that those attacks can be repeated, retransmitted, copied, distributed and manipulated ad nauseam in this internet era.

Obama’s greatest victory would be to get Jews to harm other Jews, G-d forbid.

That should never happen.

Land for peace has never worked.  Any mathematician can easily say there is no chance, such a formula is doomed.

Peace for Peace. That’s a possibility.

Israel has only ONE possible answer to Obama.

ISRAEL, JUST SAY, FIRMLY, UNHESITATINGLY, “NO” TO OBAMA!

Well, it would appear that my friend, @ElianaBenador has been classified, too hot to handle by the Washington Times. Her blog, "In The Eye of The Storm", which focuses on Islamic Terror activity has been shut down. Here's the link http://communities.washingtontimes.com/neighborhood/eye-storm/ where you'll see that it has been closed.

So it would appear that Ms. Benador has stuck an Islamic nerve and the will of a few loud Muslim voices WIN! Who is next? Or do you write in and DEMAND that her blog is reinstated! Here's a link to the last entry at the Washington Times. It's all about PRINCIPLE people! Demand this CHANGE! United we stand!
