Mark Levin talks about his new book with an expert panel on Hannity – The Liberty Amendments

Mark Levin appeared on Hannity (on 08.16.13) along with a great expert conservative panel for a full hour special to discuss his new bestseller, The Liberty Amendments (Kindle), and the solutions for America covered therein.  For anyone who is not familiar with Mark Levin, he is an attorney, radio talk show host, Constitutional expert and served as part of Ronald Reagan’s team.  Great questions from the panel and a great discussion with Levin.

Levin said, “We are living in a ‘Post Constitutional World’”, but reminded us that the Founders of our country and writers of the Constitution gave us article 5… for just such a time.  Many conservatives have been afraid to go move forward with a Constitutional Convention to reclaim the Republic, but as Levin pointed out… what is there to be afraid of?  The other side already has and does what they want.  He said there are, of course no guarantees of the outcome, but he said he does know what the outcome will be if we continue going down the road we are now on.  Mark offers what he call the Liberty Amendments and a pathway for Americans to take to save the Republic.

Only 20% of America consider themselves to be liberals or Progressives.  40% consider themselves to be Conservatives.  And the other 40% are pretty much disengaged.  Yet the 20% are wagging the dog…

Human Events: Radio host Mark Levin’s new book, The Liberty Amendments: Restoring the American Republic, is one of the most focused, accessible, and aggressive political books you’ll ever find. Levin’s thesis is that the balance of power between the three branches of the federal government, the states, and the American people has been distorted beyond the ability of conventional politics to repair. After all, if the power of the legislature has been diminished relative to the executive, the executive has dispersed its disproportionate power into unelected bureaucracies, and the states are increasingly powerless vassals of Washington, then there is no way for the peoples’ representatives in Congress or state houses to draft laws that would correct the situation. The entire point of this century-long quest to centralize power was to remove it from the clumsy hands of foolish American citizens. We are spectators to a game show in Washington. We might be able to vote a few of the contestants off the show, but we have no control over the rules of the game.

Levin aims to change the rules of the game… or, more properly, reset them, to restore the brilliant system put in place by America’s Founders. With the situation explained and his goals set forth in a few introductory pages, he executes the rest of his book with the planning and precision of a SEAL team taking an objective. Each of his proposed “Liberty Amendments” is laid out in a brief chapter that explains its importance, sources it to the writings of the Founding Fathers, and anticipates the more reasonable objections that would likely be raised. Little time is wasted on the unreasonable objections, for Levin does not intend to address an audience of the stupid, greedy, or hysterical. He also knows his statist adversaries are not interested in rationally discussing the death of the Leviathan they nourished for generations.

A Constitutional reset is necessary because the progressive project is a cascade of lost freedoms, designed so that each step is irreversible, and every inch of ground taken by the State is claimed forever. The distribution of power to unelected bureaucrats is a key element of this process. One of the Liberty Amendments “sunsets” all federal departments and agencies, unless Congress reauthorizes them every three years by majority vote. Every big-ticket Executive Branch regulation would be subjected to review by a joint congressional committee. This amendment would pull the plug on the unstoppable federal bureaucracy, forcing every department to perpetually justify its existence, and terminating President Obama’s beloved practice of circumventing Congress to legislate by decree.

Another Liberty Amendment likewise reins in the judicial branch, setting term limits for Supreme Court justices, and giving Congress the power to override Supreme Court opinions with a three-fifths vote, without risk of presidential veto. Three-fifths of the state legislatures can also join forces to knock down a Court decision. That’s a recurring theme of the Liberty Amendments: the restoration of both congressional and state power. As Levin repeatedly reminds us, nothing worried the Founders more than the rise of a despotic national executive, such as the one we have now. The original states never would have signed on to a federal government that turned them into puppets. There were strong logical arguments against these outcomes, which power-hungry progressives understood quite well, back when they first set about overturning the Constitutional order. Modern progressives don’t think they need to understand those arguments any more, because the foundation of the total State has been laid, and the clock can never be “turned back,” as one of their favorite slogans has it. This should leave them at a severe intellectual disadvantage, if the Liberty Amendments become a topic of national debate.

Some of Levin’s proposed amendments are intended to clarify language that already exists in the Constitution, such as the much-abused Commerce Clause – lately interpreted as a warrant for unlimited federal control of all human activity, although the Founders most certainly did not intend it to be taken that way. Our language has changed over the centuries, always in a way that expands the Left’s desire for centralized control. The authors of the Constitution would find our current understanding of the word “commerce” to be utterly deranged – indeed, they might even ask what the point of their Revolution was, if “interstate commerce” was to become a writ for powers beyond the wildest dreams of daft old King George.

Two of the proposed Liberty Amendments are devastating blows against imperial federal power, making it easier for states to amend the Constitution, and giving them a brief window of opportunity to strike down both congressional legislation and Executive Branch legislation. Levin also makes a compelling argument against the Seventeenth Amendment, which provided for the direct election of United States senators. Senators were supposed to be instruments of the state legislatures, while the House of Representatives would be filled by popular vote. I have never read a better explanation for why this was important, and how it gave state governments a vitally needed hand in the crafting of federal legislation.

I’ve also seen no better case made for term limits on Congress, as Levin astutely points out that not only do Jurassic representatives-for-life distort the distribution of power in Congress, but they invest a great deal of our national energy (and funding!) in maintaining their 85-percent-plus re-election rate. Surely some of those “safe” districts would merely replace Retiring Party Drone A with New Party Drone B, but as it stands, far too many representatives discover they can most easily secure lifetime tenure by representing the Leviathan State instead of their constituents, tapping the federal treasury to purchase reliable voters.

The reason all of these goals must be accomplished through Constitutional amendment is that any other instrument of legislation or representation can be twisted to the purposes of the central State. Levin makes an irrefutable case that we long ago passed the point of no return for reforming our bloated, degenerate, dying federal government by winning a few elections. The people who rigged this system made certain to armor it against future dissent from unhappy voters – one man, one vote, one time, every step of the way, with each new progressive “achievement” promptly declared more immutable than the tattered old scrap of parchment kept under glass at the National Archives. Having studied the provisions for a Constitutional convention, Levin is convinced that the high bar for state ratification of any proposed amendments will keep it from becoming a carnival of kooks. The kooks are winning anyway. What could they get by amending the Constitution that our eternal bureaucracy and despotic executive branch aren’t giving them, one lost liberty at a time?

If you want to bring the ship of state into drydock, instead of slightly adjusting its course, The Liberty Amendments provides an excellent set of schematics. Levin’s strategy is the only way for the American people to have a say on all the things we’ve been told we don’t get to vote on any more. Reading this book will help you appreciate the terrible magnitude of what we have lost, and the intractable nature of an arrogant system that dictates to us instead of representing us, appropriating the language of “democracy” to dignify what really amounts to quelling dissent against whatever the ruling class wants to do next. And if you’re not already a Constitutional scholar of Mark Levin’s caliber, you might be surprised to learn just how accurately the supposedly out-of-touch and obsolete Founders predicted everything happening today. Why, reading Chapter Eight of The Liberty Amendments, you’d think John Adams was taking daily delivery of the New York Times through a time warp. I suspect he and his peers would have little argument with Levin’s recommendations.

THE VETTING: Ben Smith Releases Selectively Edited’ Obama Race Video

Earlier today, Buzzfeed’s Ben Smith announced on Twitter that video researcher Andrew Kaczynski had released “the mysterious Harvard/Obama/race video that the Breitbart folks have been talking about.”

The video, which Kaczynski says was “licensed from a Boston television station,” shows a young Barack Obama leading a protest at Harvard Law School on behalf of Prof. Derrick Bell, a radical academic tied to Jeremiah Wright--about whom we will be releasing significant information in the coming hours.

However, the video has been selectively edited--either by the Boston television station or by Buzzfeed itself. Over the course of the day, Breitbart.com will be releasing additional footage that has been hidden by Obama's allies in the mainstream media and academia.

Breitbart.com Editor-in-Chief Joel Pollak and Editor-at-Large Ben Shapiro will appear on The Sean Hannity Show to discuss the tape. The full tape will be released tonight on Fox News' Hannity.

Latest update on the lack of progress for Dems and Republicans to reach a tax deal. Yesterday Democrats of the Super Committee rejected Republicans' offer to "raise federal tax collections by nearly $300 billion over the next decade."

Senator Rand Paul exclusively has JUST told Sean that not only are Democrats rejecting offers put on the table, but now they won't even continue to negotiate and have "walked away from the table...refusing to talk to the Republicans."

Paul warns the American people that this is all about Obama's reelection, and the taxpayers livelihood is of no concern to Obama and the Democrats.

P: And the truth is quite the opposite the republicans have offered tax reform that lowers tax rates and closes loopholes.The president talks about millionaires not paying their taxes, we are trying to close some loopholes, but we want to be part of tax reform. We have offered a serious credible offer, but basically they have walked away from the table.

The super committee was a farce from the beginning. They never had any intention of cutting spending.  It was a way of gutting the military and grabbing more power.

California’s Delta Smelt is Raising Your Food Prices

The Commerce Clause that regulates interstate commerce is at issue in the legal battle of Obamacare.  Can the federal government tell individuals that they must buy insurance?  Not as well known is how the same commerce clause is destroying farms and raising food prices by stopping the flow of water from the Sacramento-San Joaquin Rivers to the Central Valley in California.      The feds at the urging of the state government has literally turned off the tap, destroying prime farmland in order to benefit the sex lives of the Delta Smelt.

Approximately 85-90% of the water from this primary source has been shut off to the Central Valley.   The smelt is a fish so insignificant that no one other than the Bezerkely-enviro-wackos and some local fisherman have heard about this tiny fish.

The smelt is fish that is native to California and, for the most part, is known to fisherman simply as “bait”.   The California enviros’ zeal to increase the population of smelt has led to a terrible federal, legal decision that shut down the water to thousands of farmers in the Central Valley; the nation’s largest and most productive farm land.    Thousands of farmers there are suffering with unemployment over 20%, scores of farms have been lost and tens of thousands of agricultural workers are now without jobs.   If California didn’t have enough economic problems, you can add shooting yourself in the foot.  The inmates are now officially running the asylum.   If we needed a poster for enviro-insanity it would be the promotion of the lowly smelt over the interests of: farmers, food production, food prices, jobs and California families.

Fortunately, the GOP is now leading the charge is to cut funding for the programs that help the smelt at the expense of the farmers.  This could lead to turning on the tap to the farmers.  But California Sen. Dianne Feinstein is fighting the farmers; leading the opposition in the Senate and choosing to stand by the smelt over people.    The Pacific Legal Foundation, (PLF) a non-profit public interest group has sided with the farmers was recently successful in obtaining a new federal district court decision to force the state to re-examine its justification for turning off the spigot.

On Tuesday, the PLF made their case in front of the Ninth “Circus” Court of Appeals hoping for permanent relief.  They argued that the Commerce Clause doesn’t allow the feds to regulate intra-states species (species that don’t cross state lines) with no commercial sales.  Let’s just hope the people prevail over the bait, however, with the insane Ninth Circus Court no outcome is certain.

The same people who had blamed Sarah Palin for the massacre at the Tucson Safeway and then taunted her for her "silence" were enraged when she responded.

Last Tuesday, the night before Palin responded, MSNBC's Keith Olbermann mocked Palin's silence throughout his show:

-- "And why is the ever self-promoting Miss Palin so quiet?

-- "And it's quiet, isn't it?"

-- "It's too quiet."

-- "The silence is deafening from the great Northwest."

It was deemed an admission of guilt that she hadn't spoken about the Tucson shooting or denied the accusations that she had inspired the shooter.

The next day, Palin posted a video response, and Keith immediately attacked her for "the worst timed political statement ever." It's almost as if liberals would attack Palin whatever she did.

Olbermann sneered about Palin's use of the phrase "blood libel," scoffing, "This, to Sarah Palin, is analogous to what is happening to her." No, not only happening to her, but to all right-wingers, tea partiers, Republican politicians, and conservative radio and TV hosts -- all of whom have been accused of complicity in murder.

On the day of the Arizona massacre, Arizona Rep. Raul Grijalva blamed the "Palin express." The father of Gabrielle Giffords, one of the victims, blamed "the whole Tea Party." The sheriff of Pima County, Clarence Dupnik, who had failed to lock Loughner up despite repeated arrests and other contacts, blamed "the vitriolic rhetoric that we hear day in and day out from people in the radio business and some people in the TV business." (Dumbnik also said: "We're not convinced that he acted alone.")

A comment on Gawker the day of the attack said: "Palin ... you now have more than just elk blood on your hands."
The next day, New York Daily News columnist Michael Daly wrote, with stunning originality: "Palin may have the blood of more than some poor caribou on her hands." (See -- he changed "elk" to "caribou.")

In an especially prissy "Special Comment" the night of the shooting, Olbermann said that if Sarah Palin "does not repudiate her own part in amplifying violence and violent imagery in politics, she must be dismissed from politics." Ditto for Rep. Allen West, ex-candidate Sharron Angle, Rep. Giffords' opponent Jesse Kelly and "the Tea Party leaders."
In response to the Arizona shooting, the governor of Rhode Island, Lincoln Chafee, banned state employees from going on talk radio, telling reporters he had been a victim of rhetorical violence himself, citing the title of one of my columns from four years ago: "They Shot the Wrong Lincoln."

In that four-year-old column, I supported Chafee's opponent in the Republican primary by pointing out that "the only person who hasn't figured out that Lincoln Chafee is a Democrat is Lincoln Chafee. As the expression goes, if Chafee switched parties, the average IQ on both sides of the aisle would go up."

My column got results: Chafee is no longer a Republican.

But the column did not produce my secret goal, which the governor has now exposed: That John Wilkes Booth return from the dead to stalk people named "Lincoln."

Yes, the governor of Rhode Island is afraid of 19th-century assassins. Whatever you do, Lincoln, don't look under the bed!
After it came out that the Tucson shooter, Jared Loughner, was a liberal pothead who hated Christianity, laughed about aborted babies, never listened to talk radio, hated George Bush and cited "Mein Kampf" as one of his favorite books to annoy his Jewish mother, liberals suspended blaming "political rhetoric" for about two days. Then they went right back to blaming conservatives for the shooting.

The media continue to avoid giving any details and simply announce that Loughner was "anti-government," implying that he's your standard George Will conservative who believes Congress has offended the principles of federalism by encroaching on the states' authority under the Constitution.

In fact, Loughner's "anti-government" beliefs consist of: burning the American flag on video; denouncing our currency with the exclamation, "No! I won't trust in God!"; and wanting to kill cops.

His other big anti-government position is that he believes the government was behind 9/11 -- just like well-known tea partiers Rosie O'Donnell, Obama's "green jobs" czar Van Jones, Rehab habitue Charlie Sheen and left-wing historian Howard Zinn.

If we're looking for a rationale other than "Loughner was nuts," I think the more relevant facts about him are that he was an atheist who detested religion and religious people, made lots of references to satanic New Age "conscience dreaming" (sic) and was involved in the occult.

When a fellow participant on a UFO website wrote a lengthy response to Loughner's question about "what is wrong or right with the current date?" which included the subordinate clause, "a day in Christ is as a thousand years," Loughner fixated on that one line, railing, "I won't listen to that fictitious crap without the author. This is laughable to notice a gospel or writing related to Christ."

Shouldn't we at least bring Bill Maher in for questioning?

So, what's their plan of attack?

Their weapon: a revived Fairness Doctrine, which would once again require stations to air divergent points of view — a clever ruse that makes station owners leery of airing controversial talk-radio hosts fearing law suits and federal sanctions.

With a new Fairness Doctrine, you could see many top conservative radio hosts canned.

Obama Fails Leadership Test... Again

Here it is: the deal of a lifetime, you're selling your company to your biggest competitor, your merging with another company, your taking your company public, your entertaining an individual on the Forbes 400 who might want to buy a 20% stake, you've been putting a proposal together for the biggest contract in your company's history and you have a meeting with the Mayor, the Seller has called and asked for your final and best offer of an acquisition that will double the size of your organization, your position is under attack and taking heavy fire, your city is under siege, the Barbarians are at the Gate!

And where is the CEO?

He's out golfing, fishing, or campaigning, because like Obama imagines "a good CEO can do more than one thing at a time" LOL!

No! A CEO PRIORITIZES his time...!

At the most critical time in any organization the CEO is AT THE HELM of the Ship, not campaigning! 

Don't you get that, Obama? Don't you understand AT ALL... what a Chief Executive Does?

McCain has stepped up and shown Leadership... Obama wants to talk some more?!?

Barack Obama: The Real Bridge to Nowhere

Senator John McCain is correct. The place for two United States Senators to debate during an economic crisis is on the floor of the United States Senate. They can present their views about what to do and attempt to gain support from their fellow Senators. 

If they cannot demonstrate leadership as Senators they will not be able to do so as president. 

They can participate in one of those political reality shows called debates anytime. At present their responsibility is to do the job they are being paid to do as United States Senators. If Obama didn't want to continue being a Senator while he ran for president he should have done the honorable thing and resign like Bob Dole did when he ran for president in 1996.
