The Lois Lerner Defense

File it the next time the IRS calls you up…

We have the president of the United States’ word as a gentleman that he knew nothing about the Internal Revenue Service’s targeting of his enemies until he “learned about it from the same news reports that I think most people learned about this.”

Furthermore, although the commissioner of the IRS, Douglas Shulman, visited Obama’s White House no fewer than 157 times, which is 156 times more than his predecessor Mark Everson ever visited the White House, we know that this was for legitimate Easter-egg rolls, as he testified to Congress, and meetings to discuss Obamacare. The Easter Bunny, one should note, visits the White House two to four times as often as the average IRS commissioner did before Mr. Shulman came along. But you can’t make a health-care omelet without breaking Easter eggs: It is one of the many distinctive features of Obama-style “health” “care” “reform” that, while it has not led to the hiring of a single additional doctor, nurse, or hospital janitor, it did require the biggest expansion of the IRS since the Second World War. So, when he wasn’t rolling Easter eggs and advising the moppets on whether they needed to declare the luxury Belgian white chocolate balls with praline filling, he was participating in vital meetings on how many extra SWAT teams he was going to need to enforce the new colonoscopy non-compliance penalty.

Let us also overlook the excellent treatment received from the IRS by members of the president’s family. Although acting commissioner Steven Miller apologized for the “horrible customer service” conservative taxpayers had gotten, a gentleman by the name of Malik Obama received impeccable, express service when he took the precaution of mailing in his non-profit application from N’giya, Kenya, rather than notoriously slower mail processing centers such as Phoenix and Dallas. Malik, the brother of President Obama, runs the Barack H. Obama Foundation, named for the president’s father. On May 30, 2011, they applied for tax-exempt status, and had their approval signed less than a month later by Lois Lerner herself, and conveniently backdated by Lois to cover the two-and-a-half years the enterprising Malik had already been raking in “tax-deductible” donations from Americans. The Washington address of the Barack H. Obama Foundation appears to be bogus, and it’s not clear whether the funds are being used back in Kenya for anything other than supporting the famously lavish lifestyle of Malik and his twelve wives. Given that the IRS is not shy about asking American conservatives for Facebook posts and lists of who attends their meetings, Ms. Lerner surely would have been within her rights to ask Malik Obama about the “exclusive” photographs currently displayed on the Barack H. Obama Foundation website of a recent meeting in Sudan, one of only four countries the U.S. government designates as a “terrorist state,” and the Foundation’s apparently extensive association with the Sudanese president and blood-soaked genocidal war criminal Omar al-Bashir. Given that the IRS likes to ask conservative taxpayers whether their friends and relatives are planning on running for office, Ms. Lerner might like to ask Malik Obama when his friend President Bashir is planning on leaving office. After another quarter million corpses?

Whatever. Let’s take it as read that, when U.S. taxpayers wind up giving tax breaks to an entity linked to the butchers of Darfur, it’s pure coincidence that the racket turns out to be run by the president’s brother. Let’s accept that Malik Obama just got lucky that his letter landed on the desk of Lois Lerner, and that, when she backdated his application for two-and-a-half years, she’d momentarily forgotten that it’s illegal for her to backdate it more than two-and-a-quarter years. Indeed, let’s take the president at his word that the existence of this shadowy IRS entity working deep within the even shadowier U.S. Treasury planted in deep cover within the shadowiest conspiracy of them all, this murky hitherto unknown organization called “the Executive Branch,” that all this was news to him. What that means then is not that this or that elected politician is corrupt but that the government of the United States is corrupt.

There seems to be ever more evidence for that. Every day brings revelations that the IRS conservative crackdown went way beyond the Tea Party. McClatchy Newspapers reports that a woman known only as “Ms. Richards” in the Cincinnati office of the IRS told Coalition for Life of Iowa that their application for nonprofit status could only be approved if they signed a letter promising not to picket in front of Planned Parenthood. Mark Drabik, a military veteran, became politically active and started giving to conservative groups only to have the IRS challenge his church donations. Catherine Engelbrecht founded True the Vote to protect ballot integrity, and within a few months her family’s business, farm, and personal taxes had all attracted IRS audits. Hundreds and hundreds of groups were consigned to the purgatory of “pending” — a term for IRS customers not as favored as Malik Obama can stretch leisurely from six months to ten to twenty to thirty, and beyond. When the most lavishly funded government on the planet comes after you, eventual guilt or innocence is irrelevant: The process is the punishment.

I am an immigrant to this great land, and I love it, but I will make a small observation from my years in the United States which I hope won’t be taken the wrong way: Like citizens of almost all Western democracies in the 21st century, Americans are overly deferential to bureaucracy, but, in my observation, they are uniquely fearful of the state’s tax collectors to a degree I have never seen with Her Majesty’s Revenue & Customs in London or equivalent agencies in Paris, Ottawa, Rome, Canberra. The IRS has, in American terms, extraordinary powers. It was, for example, amusing to see Lois Lerner plead the Fifth Amendment and exercise her constitutional right not to put herself at risk of self-incrimination. As the great Walter Williams pointed out the other day, every single American waives his Fifth Amendment rights every time he signs that tax return on April 15. Americans are fearless if some guy pulls some stunt in a shopping mall, but an IRS assault is brutal and unending. Many activists faded away, and the media began writing stories about how the Tea Party had peaked; they were over; they wouldn’t be a factor in 2012. And so it proved. As Rush Limbaugh pointed out the other day, the plan worked.

But, of course, there was no plan, was there? So let’s take Obama at his word that he had no idea all this was going on. In that case, he might like to take the lead in calling for the abolition of a corrupt agency and its grotesque tax code, and their replacement by a bureaucracy with more limited powers commensurate with a free society and a simplified tax regime with lower rates and thus fewer bewildering, mercurial “exemptions” that make the citizenry dependent on the caprices of Ms. Lerner and her colleagues. That’s a prize worth fighting for. In the meantime, the next time the IRS call you up with demands for this and demands for that, simply tell them, “I am filing the Lois Lerner defense,” and then say as she did to Congress “I have not done anything wrong. And I will not answer any questions.” Every man his own Lois Lerner!

IRS in Defense Over Dance Video:

(CNN) – A newly obtained video has the IRS running damage control on a new front, as the embattled agency prepares for the release next week of an inspector general report that will be critical of how money was spent on staff conferences.

In the video, an apparent team-building exercise, employees are taught the Cupid Shuffle dance move as they prepare to present the dance as a group at a 2010 conference.

The IRS said Friday night the video “was unacceptable and an inappropriate use of government funds.”

The video’s narrator describes the group of individuals as executives from the Small Business/Self Employed (SBSE) department. They say they’re competing “to become the next great dance sensation.”

The IRS said the video cost $1,600 to produce, and it played at the end of a 2010 leadership and education meeting in Anaheim for 2,600 managers in the SBSE division.

“The meeting took place at a time where the IRS needed to ensure that managers had proper training to address significant new programs, major staff turnover and a substantial increase in security threats following the suicide attack on an IRS facility in Austin earlier in the year,” the IRS said in a statement.

Throughout the nearly-three minute video, the employees poke fun at each other as they try to learn the dance moves.

The new video comes as the IRS takes heat over its admitted targeting of conservative groups who sought tax exempt status.

Next week, the Treasury Inspector General for Tax Administration (TIGTA) will release an audit showing excess spending at the IRS conference.

The IRS has already come under scrutiny for Star Trek and Gilligan’s Island-themed training videos it produced that costs tens of thousands of dollars. The Star Trek video, reported earlier this year, played at the same conference as the dance video.

“And I thought doing the Star Trek video was humiliating,” one woman says in the new video.

In fact, one of the employees in the Star Trek video was also in the new dancing spot.

Acting Commissioner Danny Werfel, appointed in recent weeks, said in a statement that the report will focus on an IRS conference that took place in 2010 and labeled it an “unfortunate vestige from a prior era.”

The Council Has Spoken!! This Week’s Watcher’s Council Results

Alea iacta est… The Council Has Spoken!, the votes have been cast, and we have the results for this week’s Watcher’s Council match up.

Ah, the problem of education and the Left…or as progressive icon Adolf Hitler once said, “Let me control the textbooks and I will control the state.”

This week’s winner, The Noisy Room’s Marxism in Education – The Infiltration of Our School Systems by the Common Core Standards takes a sharp look at what the Left and the teacher’s unions are doing to our children labeled as ‘education’ Here’s a slice:

Today, I caught Glenn Beck on The Blaze and his excellent showcasing of Obama’s Common Core Standards that are now in 45 states, including my state of Idaho. Common Core is Marxism for children. It is state run propaganda and is meant to dumb down and control our little ones. It is evil and it has been a long time coming. Obama pushed it through slyly and quickly after coming into office, but I can tell you, this has been brewing since at least the 1990s.

A little background… When my children were in school in the 1990s, my husband and I requested to see the school curriculum for their school in Las Vegas, Nevada. We were refused and basically told we were too dumb to understand what the teachers were instructing our son and daughter in. The last straw came when they wanted to put my daughter in the second grade on Ritalin instead of disciplining her. I was pulled in front of four teachers and accused of not raising my daughter correctly, as well as basically being an abusive and stupid parent. I promptly told these teachers that they could pound sand and pulled our children (our son was in third grade at the time) out of school that very same day. I left the Fortune 500 and home schooled both of them till high school and in retrospect, should have kept them out even then. My children could not do the simplest of math or read when we pulled them out. I tested them and started them all over again with the ABEKA home schooling system, which at the time, cost a great deal of money. The children were tested by the state within a week of being pulled out and because they could not read or do math, the state threatened to remove our children, even though it was their damn lack of teaching that had produced this. Well, we knuckled down and by the end of the following year, both kids were excellent readers and were caught up in math. I never heard from the state again. My son went on to be a gifted software developer and although my daughter is still trying to find her way in the world, she is a talented artist and a survivor. Now on to the present matter at hand.

My friend and fellow blogger Michelle Malkin has done a set of four in-depth articles on reporting on the Common Core Standards as well as additional pieces providing more information. Her work is very well done. Before her write-ups, I would wager most parents had never heard of Common Core. There are now many teachers who are quitting and/or standing up against this Progressive travesty that is intent on corrupting our schools and students.

In our non-Council category, the winner was Mark Steyn with An unstable truce with the Axis of Crazy submitted by The Noisy Room. In this one, Steyn takes on some of the more ridiculous aspects of our current foreign policy bufooonery – only it’s unfortunately no joke.

OK, here are this week’s full results. Simply Jews and Bookworm Room were unable tovote thi sweek, but neither was subject to the usual 2/3 vote penalty for not voting.

Call a radio talk show, get recorded by the FBI ... And Gov’t to Take Control Of Communications Temporarily On 11/9/11

Next time you call a talk radio station, beware: The FBI may be listening.

According to WMAL.com, "The FBI has awarded a $524,927 contract to a Virginia company to record as much radio news and talk programming as it can find on the Internet. … The FBI says it is not playing Big Brother by policing the airwaves, but rather seeking access to what airs as potential evidence."

The agency's reasons for recording all these radio programs don't get any clearer as the news report goes on. No doubt that is intentional.

Rush Limbaugh

"Don't hold out hope for Palin."

That was Rush Limbaugh's advice to a caller who was clinging to hope that the former Alaska governor would finally enter the 2012 Presidential race.

"You've got practical things like filing deadlines coming up, some are within a week now," Rush explained, "so I think it's time to move on. I think it's time to let go and move on" (FREE audio).

Ken Hoffman at the Houston Chronicle complained that, "Limbaugh is now calling first lady Michelle Obama … 'Moo-Chelle Obama.' Even for El Rushbo, that's stupid and insensitive. Limbaugh reportedly earns $38 million a year and lives in a beachfront mansion in Palm Beach, Fla. He can't afford a mirror?"

Michael Savage

This week, Michael Savage labeled Barack Obama a "lifetime Marxist" and renewed concerns about his eligibility to serve as president.

He explained to listeners: Obama is "a man who refuses to show a valid birth certificate, a man who applies for college aid as a foreign student and then denies he's foreign, a man who has a Social Security number from a state he's never even lived in." (FREE audio).

Savage also declared: "The second Bolshevik revolution is beginning in the United States of America, egged on by our first communist president and his cronies. Obama is using the rabble in the gutters to draw attention away from the 'Fast and Furious' Mexican gunrunning scandal, and all the other scandals in this administration":

Sean Hannity

The New York Times shadowed Sean Hannity as part of a story about Fox News' 15th anniversary, and were forced to concede: "Despite the inflammatory rhetoric he instigates, Mr. Hannity is good-natured and humble in person, as interested in his children's tennis matches as in Mitt Romney's foreign policy positions. He rarely agrees to interviews, and when he did last week, he said he did not read negative articles about him, or even the friendly Twitter account all about his abundant head of hair."

Newt Gingrich joined Hannity on the air to analyze the most recent GOP candidate's debate, both his own performance and those of the other potential Republican nominees (FREE audio).

Mark Levin

"These debates are starting to bore me," Mark Levin told listeners this week. He complained that there were too many participants, and none of them will dare take on Mitt Romney (FREE audio).

Speaking of Romney, Levin slammed New Jersey Gov. Chris Christie for endorsing him. Levin feels neither of these men are "true" conservatives, and he is tired of hearing that "conservatives can't win" (FREE audio).

Laura Ingraham

Two Republican governors offered Ingraham different takes on who could take the White House in 2012.

Mississippi Gov. Haley Barbour told Laura and her listeners that Herman Cain would "sweep the South" if he is the GOP nominee (FREE audio).

However, former Pennsylvania Gov. Ed Rendell told her, "If the election were held today, Mitt Romney would defeat Barack Obama in Pennsylvania – a state the president won by roughly 10 points in 2008."

Rendell warned the party not to select a "wacky" nominee, and stick with somebody "competent." He added, "Sometimes I think the Republican Party has a death wish."

"I actually agree with you on that," Ingraham replied. "In many ways I think the Republicans can screw things up easily."

Glenn Beck

Glenn Beck expanded his business empire this week, announcing the launch of his "1791" clothing line.

Beck explained, "The main thrusts of the 1791 line are to remember where we came from as Americans ... and to restore values and efforts that have made America great."

Beck sided with Hank Williams Jr. this week, after the singer/songwriter got in trouble for making a clumsy analogy that mentioned "Hitler" and "Obama" (but contrary to what's been reported, he didn't compare the two.) Beck played excerpts of Williams' new song"Keep the Change," and condemned ESPN and his former employers at Fox News for throwing Williams under the bus (FREE webcam).

And now, from the left side of the dial ...

Did you ever think you'd live to see a cable news host question the "blackness" of a potential president?

That's what happened when Al Sharpton and Prof. Karen Hunter struggled to make sense of Herman Cain's campaign for the Republican nomination (FREE audio).

Weirder still, the producer of progressive Stephanie Miller's radio show made a bizarre on-air suggestion that Cain was an anti-Semite. It was so outrageous even Miller expressed her embarrassment and tried to change the subject.

While these outbursts are painful to listen to, they reveal the unprincipled desperation of people whose worldview is crumbling before their eyes. That's probably the only redeeming social value these radio programs have.

FEMA Communication Takeover Test Scheduled for November 9

FEMA, the FCC, and Homeland Security plan to commandeer the airwaves next month. The Emergency Alert System (EAS) will be tested at 1 PM EST on November 9. EAS alerts are transmitted over radio and television broadcast stations, cable television and other media services.

Local and state EAS components are tested weekly and monthly, but this will be the first national test of the system. It is significant that FEMA will conduct the mandatory test.

No turning back from Obamacare

Even a watered-down version of Obama's plan would shift the country permanently to the left.

My conservative friends – and even a few media liberals – are agreed: The bloom is off the Obama rose. He's not the Obamessiah, just another 50 percent president. He tried to do too much too fast, and his numbers are sinking. The Europeanization of health care is dead. Fuhgeddabouddit.

I wouldn't be so sure. President Barack Obama has no choice but to move fast, in part because the image he presented during the campaign – a post-partisan, post-racial, post-anything-unpleasant-and-controversial pragmatic centrist – was a total crock. He has a vast transformative domestic agenda and, because most of its elements are not terribly popular, he has to accomplish it at speed or he won't get it done at all.

Health care "reform"? As we've seen this past week in the House of Representatives, put not your trust in "Blue Dog Democrats." And, as we'll no doubt see in the weeks ahead in the Senate, put not your trust in "moderate Republicans" whose urge to "reach across the aisle" is so reflexive it ought to be covered by the Americans With Disabilities Act.

The president needs to get something passed. Anything. The details don't matter. Once it's in place, health care "reform" can be re-reformed endlessly. Indeed, you'll be surprised how little else we talk about. So, for example, public funding for abortions can be discarded now, and written in – as it surely will be by some judge – down the road. What matters is to ram it through, get it done, pass it now – in whatever form.

If this seems a perverse obsession for a nation with a weak economy, rising unemployment and a war on two fronts, it has a very sound strategic logic behind it. As I wrote in National Review a week or two back, health care is the fastest way to a permanent left-of-center political culture. That's its attraction for an ambitious president: It redefines the relationship between the citizen and the state in a way that hands all the advantages to statists – to those who believe government has a legitimate right to regulate human affairs in every particular.

That's not why it's tanking in the polls, of course. It's floundering because Obama sold it initially on the basis of "controlling costs," and then the Congressional Budget Office let the cat out of the bag and pointed out that, au contraire, it would cost $1.6 trillion, and therefore either add to an unsustainable deficit, or require massive tax increases, or (more likely) both.

All of which is true. But to object to the governmentalization of health care on that basis implicitly concedes the argument that, if we could figure out a way to bring the price down, it would be fine and dandy. Right now, there are a lot of wonkish and utilitarian objections to what the Democrats want to do, and they're gaining traction. In The American Spectator, Brandon Crocker points out that this is exactly the way things went over Hillarycare in 1993: Americans took against the plan on practical grounds but not against the underlying principle. "Since we did not win that philosophical argument in 1993," Mr. Crocker writes, "we now have to fight the same battle today." And, if we win on utilitarian grounds today, we'll have to fight it again in 10 years, five years, maybe less – until something passes, and then everything changes, forever: As the IRA famously taunted Margaret Thatcher, we only have to get lucky once; you have to be lucky every day.

On the price tag: It's often argued that, as a proportion of GDP, America spends more on health care than countries with government medical systems. But, as a point of fact, "America" doesn't spend anything on health care: Hundreds of millions of people make hundreds of millions of individual decisions about what they're going to spend on health care. Whereas up north a handful of bureaucrats determine what Canada will spend on health care – and that's that: Health care is a government budget item. If Joe Hoser in Moose Jaw wants to increase Canada's health care spending by $500 drawn from his savings account, he can't: The law prevents it. Unless, as many Canadians do, he drives south and spends it in a U.S. hospital for treatment he can't get in a timely manner in his own country.

You can make the "controlling costs" argument about anything: After all, it's no surprise that millions of free people freely choosing how they spend their own money will spend it in different ways than government bureaucrats would be willing to license on their behalf. America spends more per capita on food than Zimbabwe. America spends more on vacations than North Korea. America spends more on lap-dancing than Saudi Arabia (well, officially). Canada spends more per capita on doughnuts than America, and, given comparative girths, Canucks are clearly not getting as much bang for the buck. Why doesn't Ottawa introduce a National Doughnut Licensing Agency? You'd still see your general dispenser for simple procedures like a lightly sugared cruller but he'd refer you to a specialist if you needed, say, a maple-frosted custard, and it would only be a six-month wait, at the end of which you'd receive a stale cinnamon roll. Under government regulation, eventually every doughnut would be all hole and no doughnut, and the problem would be solved. Even if the hole costs $1.6 trillion.

How did the health-care debate decay to the point where we think it entirely natural for the central government to fix a collective figure for what 300 million freeborn citizens ought to be spending on something as basic to individual liberty as their own bodies?

That's the argument that needs to be won. And, if you think I'm being frivolous in positing bureaucratic regulation of doughnuts and vacations, consider that under the all-purpose umbrellas of "health" and "the environment," governments of supposedly free nations are increasingly comfortable straying into areas of diet and leisure. Last year, a British bill attempted to ban Tony the Tiger, longtime pitchman for Frosties, from children's TV because of his malign influence on young persons. Why not just ban Frosties? Or permit it by prescription only? Or make kids stand outside on the sidewalk to eat it? It was also proposed – by the Conservative Party, alas – that, in the interests of saving the planet, each citizen should be permitted to fly a certain number of miles a year, after which he would be subject to punitive eco-surtaxes. Isn't restricting freedom of movement kind of, you know … totalitarian?

Freedom is messy. In free societies, people will fall through the cracks – drink too much, eat too much, buy unaffordable homes, fail to make prudent provision for health care and much else. But the price of being relieved of all those tiresome choices by a benign paternal government is far too high.

Government health care would be wrong even if it "controlled costs." It's a liberty issue. I'd rather be free to choose, even if I make the wrong choices.
